General Terms and Conditions of Purchase
1. Scope of Application
For all orders placed through our online shop the following terms and conditions apply. Please read these terms carefully and make sure that you understand them, before ordering any products from our website. You may print and store a copy of these terms for your records. Please note that before placing an order you will be asked to agree to these terms. If you refuse to accept these terms, you will not be able to order any products from our website. We may amend these terms from time to time. Every time you wish to order products, please check the terms to ensure you understand the terms which will apply at that time.
2. Parties and Conclusion of Contract
Identity of the Seller:
This Online Shop Website is operated by AFFS-Europe (Academy for Future Science, Europe), a "Verein" registered at Hofplatz 7, 9220 Bischofszell, Switzerland.
Identity of the Purchaser:
The purchase agreement shall be between the Purchaser/customer and AFFS-Europe (Academy for Future Science, Verein). For the purposes of these terms, the term “Purchaser” means the person buying our products on the Website. To be eligible to purchase products on our website, the Purchaser must be an end-consumer (i.e. an individual, not acting as a retailer) and must be at least 18 years old. By placing an order, the Purchaser agrees that *) they are eligible to purchase products on our website; *) the purchase of products on our website is unrelated to any professional activity and is limited to personal use; and *) they will not resell or distribute the products purchased on the website or any samples.
Information on the products:
The images of the Products in our Online shop are for illustrative purposes only. The presentation of products in our online shop does not constitute a legally binding offer, but solely a non-binding online catalogue. All products shown on the Website are subject to availability. AFFS-Europe will inform the Purchaser by e-mail as soon as possible if the Product ordered is not available. AFFS-Europe reserves the right to add new products, remove products or change their appearance or price at any time.
The Purchaser selects the product(s) of his/her choice and adds it/them to the “Cart”. As soon as the Purchaser confirms his/her order by clicking on the “Confirm order” button, the Purchaser is considered to have confirmed the contents and conditions of the order, the prices, characteristics, quantities and delivery deadlines for the ordered products. The order cannot be amended after this point.
After the order is placed, AFFS-Europe sends the Purchaser an e-mail summarising the order. Please note that this does not mean that the order has been accepted. AFFS-Europe accepts the order by sending a declaration of acceptance in a separate e-mail or by delivering the goods. Exception: If you choose the payment method PayPal or Credit Card (VISA or MASTERCARD), the contract comes into effect on the date of your payment through PayPal or VISA/MASTERCARD.
Cancellation of the order:
AFFS-Europe reserves the right to cancel any orders at its discretion including without limitation: *) where the products are unavailable; *) where the Purchaser orders more than four (4) products of one reference; *) where AFFS-Europe has reason to believe that the Purchaser does not comply with the eligibility criteria set out in these terms; *) where the information provided by the Purchaser is incomplete or inaccurate; *) where there is an event of default on payment or partial payment of amounts owed by the Purchaser; and *) where there are events beyond AFFS-Europe's control. The Purchaser may cancel his/her order by exercising his/her right of withdrawal under the conditions stipulated in clause 3 (Withdrawal).
3. Voluntary Right of Withdrawal
According to Swiss Law there is no general right to withdrawal that would enable the customer to change his/her mind up to 14 days after the purchase and return the product without giving a reason.
We are sure that your will like our products. Nevertheless, we are offering you a voluntary right to withdraw from the contract of purchase without stating a reason. The cancellation period is fourteen days from the day that you or a person appointed by you (other than the deliverer) has received the order.
Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments we received from you, including delivery costs, and repay them immediately or within fourteen days from the date on which the written notification of cancellation has been received by us. Repayment will be made using the same method of payment that you used in the original transaction, unless another arrangement has been made with you. Costs incurred for making the repayment, however, such as banking fees, will be charged to you. We may withhold reimbursement until we have fully received the returned goods, or until you have demonstrated that you have returned the goods, whichever is the earlier.
You must return the goods to us immediately and in any event not later than fourteen (14) days from the date on which you inform us about the cancellation of this contract. The deadline is met if you post the goods within 14 days (date of postmark). The Purchaser bears the postal cost for returning the goods. Loss of value of the returned products must be covered by you only if such loss is due to unnecessary handling of the goods other than to ascertain the nature, characteristics and functioning of the products.
Exceptions from withdrawal
Expressly excluded from the cancellation and return option are 'Download Products' (digital products) that by their nature cannot be returned, as well as opened or unsealed data carriers (such as CDs, DVDs, or other digital media) whose seal or packing has been broken or removed.
Also excluded from your right of withdrawal and return are bookings of our events (seminars, webinars, conferences, workshops) for which the cancellation conditions under Clause 4 shall apply.
4. Cancellation Policy for Booked Events
For any bookings of events (seminars, webinars, conferences, workshops) that you made and paid for through our webshop the following cancellation conditions apply:
Participants who have not yet received their ticket or entry card to the event must also cancel their participation in writing by email no later than three (3) days prior to the event in order to receive the refund of participation fees less 15 Euros for banking and handling charges.
Later cancellations or belated return of entry cards will not be refunded.
5. Shipping costs
The product prices specified in our online catalogue are inclusive of VAT but exclusive of shipping costs. These will be added based on the total weight of the order and the country to which the order will be delivered. Details on the amount of shipping costs will be displayed during checkout or can be seen in the table of shipping costs.
Our Online Shop currently allows for the following payment methods:
With the advance payment (prepayment) method the Purchaser pays the amount due onto our bank account the details of which appear in the order confirmation/invoice that will be emailed to you. Products will be delivered after the payment is received.
You may pay the invoiced amount through the online provider Paypal. You must have a Paypal account or open a new Paypal account in order to make the transaction. By selecting the Paypal payment method you will be automatically taken to the secure Paypal website to carry out the transaction. When paying through Paypal a transaction charge of 3% of the invoice amount will be added.
We accept VISA and MASTERCARDS. By selecting the payment method Credit card you will be redirected to the secure payment system of Saferpay by SIX Payment Services AG, where you must enter your credit card details. Payment by credit card incurs a surcharge of 4.5% of the order amount.
7. Collection/Pickup of Goods
The pickup of ordered items at our premises is possible only in very exceptional cases and with prior appointment.
8. Retention of Title
All products remain our property until we have received full payment.
9. Transport Damages
Upon delivery of the order, the Purchaser should immediately check the condition of the package. If the Purchaser has any concerns regarding the condition of the package or if any products are missing from the order or are incorrect or faulty, the Purchaser should immediately inform the delivery driver and notify his/her concerns to AFFS-Europe as soon as possible. The products will be the Purchaser’s responsibility from the time of completion of delivery. The Purchaser will own the products once they have been delivered to them provided that AFFS-Europe has received payment in full, including all applicable delivery charges.
10. Saving of Contract Text
We will save the contract text and will send you the ordering data by e-mail. These Terms and Conditions can be viewed and downloaded from our webshop at any time. You can view your past orders in our customer login.
11. Place of Fulfilment and Jurisdiction
The place of fulfilment and jurisdiction is Bischofszell (TG), Switzerland.
